2. Warranty Provided by the Company

The Service related to the use and access of the website, that does not result into any sale of Products by the Company, is provided to the User on "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Company, on its own behalf and on behalf of its Affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Service and use of this website regarding the accuracy, updation, use of the content of the website related to the product details or any other information contained in the website.

For the Service related to the use and access of the website that results into any sale of Products by the Company, the Warranty provided by the Company is limited to the Warranty related to the Products, which is One year from the date of Invoice and is confined only to the Manufacturing defect in the Product. The Company disclaims any other implied warranty of Merchantability or fitness for a particular use of the Product by the User. Further such services are only provided in India.

Without limiting the foregoing, neither the Company nor any of the company's provider makes any representation or warranty of any kind, express or implied: (i) as to the operation or availability of the Service, or the information, content, and materials or products included thereon; (ii) that the Service will be uninterrupted or error-free; (iii) as to the accuracy, reliability, or currency of any information or content provided through the Service; or (iv) that the Service, its servers, the content, or e-mails sent from or on behalf of the Company are free of viruses, scripts, trojan horses, worms, malware, timebombs or other harmful components.

For the Service related to the use and access of the website that does not result into any sale of Products, the Company accepts no liability for any damages incurred or suffered by User by using this website including but not limited to any addition, deletion, modifications, suspension or termination of any information or access to this website.

For the Service related to the use and access of the website that results into any sale of Products by the Company, the entire liability of the Company and any of its suppliers under any provision of this Terms and the exclusive remedy of the User shall be limited to the amount actually paid by the User notwithstanding any damages that the User might incur.

The Intellectual Property Rights related to the materials, information, documents, images, videos, audios, presentations, product related information provided on the website as well as the Trademark & logo related to the Brand, “Magnus” and other trademarks & logos related to the Products & Services of the Company are the sole Property of the Company irrespective of whether any Intellectual Property protection has been taken or not by the Company.

The User shall not use, copy, reproduce or infringe in any way the copyright and trademarks of the Company without the prior written consent of the Company.

The Webiste/ Service may contain links to third-party web sites or services that are not owned or controlled by the Company.

Company may terminate or suspend any Services or restrict the access of the User at any time, without prior notice or liability, for any reason whatsoever, including without limitation if the User breach these Terms and Conditions.

Upon termination, the right to use the Service will cease immediately.

The use of this website/ Service and the terms and conditions shall be governed by the laws of India and the courts at New Delhi shall have exclusive jurisdiction for any disputes arising out of the use of this website.
